Derick Payne, 53, was arrested for second degree battery after an evening of drinks with his brother turned into much more.
It was on Aug. 23, 2022 when the victim told officials he was headed home when he spotted his brother’s vehicle in a business on Hatteras Ave. According to arresting documents, the victim said “he stopped in to speak and have a drink or two with his brother.”
After a “pleasant” evening together, when the victim said he was headed to the restroom, Payne said he too needed to go to the bathroom. But as Payne followed his brother, documents say “he struck him in the back of his head with a closed fist.”
The victim was knocked unconscious and fell to the ground. When he regained consciousness, Payne was “throwing a barrage of punches towards him.” The victim added his brother “had to be pulled off of him by other patrons and as he was being away, Payne bit the victim several times before being pulled away.”
The victim had to be taken to a hospital for his injuries. His medical report indicated he suffered a concussion, contusion to the head and a nose fracture. In fact, even when officers interviewed the victim two days after the incident, they said he was sensitive to light, his eye was black and blue and he had a contusion to the back of his head/neck area.
It’s why Payne was arrested for second degree battery.
It’s still unclear what exactly led to Payne allegedly beating & biting his own brother.
